This session will look at employment legislation in the context of Outcomes 12-14 of the Care Quality Commission’s Essential Standards of Quality and Safety (so far as these relate to employment/workers’ law). There is particular reference to employment claims in employment tribunals.

Learning Objectives

By the end of this session you will be able to:

  • Identify the need for compliance with employment/workers’ legislation, including the Care Quality Commission’s (CQC) Essential Standards
  • Identify the necessary framework documentation
  • Describe the basic risks leading to employment claims and how to address them
  • Explain the need for early professional advice in a complex and high risk area

Employment protection originally applied to ‘employees’ only, but recent legislation tends to use the concept of ‘worker’ more widely, the wider term ‘worker’ embracing the lesser term ‘employee’.

Entry Requirements / Prerequisites

Before commencing this session you should:

  • Have read and considered Outcomes 12-14 of the CQC’s Essential Standards of Quality and Safety, although there is only scope within the session to touch on Essential Standard 12 [1]
